Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms and Conditions and our Privacy Policy. These policies apply to all visitors, users, and others who wish to access or use the Service, including individuals requesting our mobile notary services.
By accessing or using the Service, you agree to be bound by these Terms and Conditions and our Privacy Policy. If you disagree with any part of these policies, then you do not have permission to access the Service.
1. Nature of Services
Chino Valley Mobile Notary provides mobile notary public services. Our services involve the authentication of signatures on documents, administration of oaths and affirmations, and other notarial acts as permitted by California law. We are not attorneys licensed to practice law and may not give legal advice. We cannot prepare legal documents, advise you on their contents, or provide legal counsel.
2. Eligibility for Services
By requesting services from Chino Valley Mobile Notary, you represent and warrant that you are at least 18 years of age (or the legal age of majority in your jurisdiction) and have the legal capacity to enter into agreements. You also confirm that you are seeking notarial services for a lawful purpose.
3. Client Responsibilities
When utilizing our mobile notary services, you agree to:
Provide Valid Identification: Present valid, unexpired government-issued photo identification that meets California notary public identification requirements at the time of the notarial act.
Ensure Document Readiness: Ensure all documents requiring notarization are complete, accurate, and ready for signature (except for the signature itself, which must be affixed in the presence of the notary). We are not responsible for reviewing the content or legality of your documents.
Provide a Safe Environment: Ensure a safe and accessible environment for the notary to perform their duties at the agreed-upon location.
Be Present: Be physically present with the notary at the time of the notarization.
Understand the Document: Affirm that you understand the nature and purpose of the document you are signing.
Payment: Pay all agreed-upon fees for services rendered, including travel fees, at the time of service unless other arrangements have been explicitly made and agreed upon in writing.
4. Notary's Right to Refuse Service
Our notary public reserves the right to refuse service to anyone at their sole discretion if:
The signer cannot produce satisfactory identification.
The signer appears to be under duress or not acting of their own free will.
The signer does not appear to understand the nature or content of the document.
The document is incomplete or appears to be fraudulent.
The requested notarial act is illegal or unethical.
The notary's safety is compromised.
5. Booking and Cancellation Policy
Generally, cancellations or reschedules made with less than 2 hours notice may be subject to a cancellation fee.
6. Fees and Payment
Fees for mobile notary services, including travel fees, can be quoted to you prior to the appointment. All fees are due at the time of service. We accept cash, Venmo, and credit cards.
7. SMS Messaging
End users can opt-in to receive SMS messages to receive appointment confirmations, appointment reminder messages, and message notifications.
Any mobile phone numbers used for SMS messaging will not be shared with third-parties.
You can cancel the SMS service at any time. Just text "STOP" to the phone number. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.

Carriers are not liable for delayed or undelivered messages
As always, message and data rates may apply for any messages sent to you from us and to us from you. Message frequency may vary. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

In no event shall Chino Valley Mobile Notary, nor its directors, employees, partners, agents, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service or our notary services; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

Your use of the Service and our notary services is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.
Chino Valley Mobile Notary, its employees, and affiliates do not warrant that a) the Service will function uninterrupted, secure, or available at any particular time or location; b) any errors or defects will be corrected; c) the Service is free of viruses or other harmful components; or d) the results of using the Service or our notary services will meet your requirements.
14. Exclusions
Some jurisdictions do not allow the exclusion of certain warranties or the exclusion or limitation of liability for consequential or incidental damages, so the limitations above may not apply to you.
15. Governing Law
These Terms shall be governed and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service and notary services, and supersede and replace any prior agreements we might have had between us regarding the Service.

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
